Justices of the Czech and Slovak Constitutional Courts met for the traditional bilateral session

Bilateral relations between the Czech and Slovak Constitutional Courts have long been exceptionally close and strong. Common history in the 20th century, geographical and linguistic proximity, similarities in the legal system in general and in the system of protection of constitutionality in particular are only some of the many phenomena behind that fact. Both courts build on the legacy of the Constitutional Court of the Czech and Slovak Federative Republic, which laid a solid foundation for modern judicial review.

The judicial bodies responsible for constitutionality review decide on cases that often have many analogies. This is especially true for the Czech and Slovak Constitutional Courts for the above-mentioned reasons. This is also why representatives of both courts meet more frequently, in different formats and on different occasions, allowing them to share valuable experience and perspectives. The most important and at the same time the most comprehensive platform for the exchange of knowledge, ideas and viewpoints is the joint meeting of the plenums of the Constitutional Courts, which is usually held every year, with the courts taking turns in organizing the event.

This year, the role of host fell to the Slovak Constitutional Court, which invited its Czech counterpart to the friendly environment of the Belianske Hills in the south of Slovakia. On Wednesday 25 October, the Justices of the two Constitutional Courts discussed two topics. Firstly, the control of the constitutionality of the legislative process, and secondly, the effects of derogation judgments in legal compliance proceedings.

The President of the Constitutional Court, Josef Baxa, appreciated the excellent organisation of the meeting and the pleasant and relaxed atmosphere, which contributed to a very fruitful and open debate. He also expressed his satisfaction that the cooperation between the two Courts remains intensive and systematic even thirty years after the establishment of independent states.
